Schedules of Condition
When Leasing commercial property, whether you are the Tenant or the Landlord, it is essential that a Schedule of Condition is prepared and preferably agreed prior to signing the Lease.
Most Leases contain covenants (or conditions) relating to the maintenance and repair of the property during the term or period of the Lease. These covenants vary but most cases make the tenant responsible for either Internal Repairs and Decorations or for Full Repairing and Insuring of the property (known as FRI terms) the latter carrying a far greater cost potential for the Tenant.
The Schedule of Condition we prepare accurately records, with the aid of colour photographs, the condition of the property at the commencement of the Lease.
At the end of the Lease, (or at a rent review) there is then little scope for dispute regarding breaches of repairing covenants.
If you are a Landlord and your property is in reasonable or good condition, the Schedule can prove that this was the case when the Lease was granted.
Conversely, if you are a Tenant and the property is in sub-standard condition at the beginning of the Lease, it is vital that there is both documentary and photographic evidence so that you are not made responsible for dilapidations that occurred prior to your Lease term.
